1. Acceptance
These terms govern the use of Alpichel (https://alpichel.com), provided by Alpichel. By creating an account or using the platform you accept these terms and our Privacy policy. If you use Alpichel on behalf of a business, you confirm you have authority to accept them for it.
2. The service
Alpichel is cloud software to run local businesses: point of sale, inventory, queue, orders, cash register, expenses, reports, loyalty, memberships, online booking, CRM, a public directory and a customer app. It runs in the browser with nothing to install.
Alpichel is not an electronic invoicing provider and does not replace the tax documents your country may require. Each business is responsible for its own tax obligations.
3. Accounts
You must provide accurate information and keep your credentials secret. You are responsible for activity on your account and on the team accounts (cashiers and hosts) you create. Tell us right away if you suspect unauthorized access.
4. Business obligations
If you register a business, you agree to:
- Tell your customers that you record their data and obtain their consent where the law requires it, especially before messaging them on WhatsApp or sending promotions.
- Use your customers' data only to serve them and not upload unnecessary sensitive information.
- Keep your prices, opening hours and public page information up to date.
- Honor the bookings you accept, or warn the customer in time if you must cancel.
- Comply with the labor, tax and consumer protection laws that apply to you.
5. App customers and bookings
The customer app lets you find businesses, collect rewards and book appointments. The service itself is provided by each business, which is solely responsible for its quality, price, payment, hours and care of whatever the customer entrusts to it. Alpichel only facilitates the booking and is not a party to that agreement.
If you cannot make a booking, cancel it in the app as soon as possible. Businesses may record no-shows and apply their own policies, which they must tell you about.
6. Plans and payments
The core features can be used for free. If paid plans or add-ons are offered, their price, limits and features are shown before you buy. Payments are processed with PayPal for 30-day periods and renew when you pay again; we never charge you automatically without your action.
Unless the law of your country says otherwise, paid periods are non-refundable, but you keep access until they end. We may change prices with prior notice; a change never affects a period already paid. Applicable taxes may be added to the price.
7. Free plans
Free plans may have limits on users or tickets, print a watermark on tickets and show ads. These conditions are shown on the plans page.
8. Acceptable use
You may not:
- Use Alpichel for illegal or fraudulent activities or to send spam.
- Try to access other businesses' data or break the platform's security.
- Copy, resell or reverse engineer the software, except as the law allows.
- Overload the service with automated or abusive processes.
- Publish false or offensive information or content that infringes third-party rights.
9. Your data
The data you enter in Alpichel belongs to you. You allow us to store and process it only to provide the service, as described in our Privacy policy. Depending on your plan, you can export your information (for example, sales as CSV).
10. Intellectual property
The software, design, the Alpichel brand and its content belong to Alpichel or its licensors. We grant you a limited, non-exclusive, non-transferable license to use it while you have an active account.
11. Availability and changes
We work to keep Alpichel always available, but there may be interruptions for maintenance, failures or causes beyond our control. We may add, change or remove features; if we remove an essential feature of a paid plan, we will tell you in advance.
12. Warranties and liability
Alpichel is provided "as is" and "as available". To the extent permitted by law, we do not guarantee it is error-free or fits all your needs, and we are not liable for lost profits, data loss or indirect damages. Our total liability is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits the rights you have under the consumer protection laws of your country.
13. Suspension and closure
You can stop using Alpichel and close your account at any time. We may suspend or close accounts that breach these terms, put the platform or other users at risk, or when ordered by an authority. Where possible we will warn you first and give you a chance to export your data.
14. Governing law
These terms are governed by the laws of Guatemala. Any dispute will be resolved before the competent courts of that country, unless the consumer protection law of your country allows you to bring a claim before your own courts.
15. Changes to these terms
We may update these terms. We will publish the new version here with its date and, if the change is significant, notify you in advance. If you keep using Alpichel after the change, you accept the new terms.
